Here's an overview of the key types of trademarks one can register

Product Trademarks

Trademarks are used to differentiate the products of one company from those of another. They can be made up of words, symbols, designs, or logos. For example, the logo of a well-known tech company or the signature checkmark of a popular sportswear brand.

Service Trademarks

Service trademarks work in the same way as product trademarks but are used specifically for services. They are particularly useful in industries like IT consultancy, hospitality, or entertainment. For example, the famous golden arches of a global fast-food chain or the recognizable symbol of a well-known streaming service.

Collective Trademarks

Collective trademarks are used by organizations or groups to represent the goods or services offered by their members. These trademarks reflect a shared standard or reputation. For example, symbols used by fair trade organizations or quality assurance marks in the wool industry.

Certification Trademarks

Certification trademarks are given by certifying authorities to show that products or services meet specific standards. They help build consumer trust and promote fair practices across industries. Examples include standardization marks from national standards organizations or quality assurance marks for agricultural products.

Shape Trademarks

Shape trademarks protect the unique three-dimensional design of products or their packaging. They are important for brands with products that have a distinct shape or appearance. Examples include the unique shape of a famous beverage bottle or the distinctive packaging of a well-known chocolate brand.

Timeline for Trademark Registration in India

Registering a trademark in India is a multi-step process, each with its timeline. Below is a general overview of the time frames associated with each stage. However, please keep in mind that this is a typical timeline, and the actual time taken may differ based on the specifics of your application and any possible objections or complications that may arise.

Filing of Trademark Application

The trademark registration process starts with filing an online application in Form TM-M with the Registrar of Trademarks. Once we receive the required documents, we will submit your trademark application within 24 hours.

Examination of Trademark & Reply Filing

Trademark applications go through a review process called "Examination," which typically takes 1-3 months. If any objections arise, the applicant will receive an Examination Report and must respond within 30 days.

Show Cause Hearing & Publication

If the examiner is not satisfied with the response to the examination report, a show cause hearing will be scheduled. Once the examiner is satisfied with the response, the trademark is published in the TM Journal, where it remains open for public opposition for 3 months.

Registration of The Trademark

After a waiting period of three months from the publication, and in the absence of opposition from the public, the Registrar of Trademarks issues a Certificate of Trademark Registration which remains valid for a period of ten years.
